Regulating AI Use by State Government

States regulating their own government agencies’ use of artificial intelligence have adopted various strategies: (a) establishing task forces to study AI use, (b) requiring risk management practices including impact assessments, (c) mandating transparency requirements, and (d) imposing procurement guidelines. Connecticut prohibits state agencies from implementing AI systems causing unlawful discrimination and requires state contracts to include data privacy provisions, while California requires agencies to designate AI monitoring employees, conduct risk assessments before deployment, and submit generative AI contracts for review.

Maryland’s SB 818 and New York’s SB 7543 are more comprehensive approaches: Maryland requires agencies to conduct impact assessments, publicly report on high-risk systems, and established a Governor’s Artificial Intelligence Subcabinet for developing monitoring policies, while New York requires impact assessments prior to deployment and prohibits automated decision-making in public benefits without human oversight.

Many public sector AI bills do not impose binding requirements but instead require reporting, pilot projects, or task forces to issue recommendations.
