Litigation and Discovery Involving AI Systems: What Lawyers Need to Know

This CLE examines how courts are treating claims involving AI systems, including liability theories, evidentiary challenges, and emerging standards for admissibility. The program addresses discovery obligations unique to AI, such as access to training data, model outputs, prompts, logs, and versioning, as well as proportionality and confidentiality concerns. Attendees will learn how to preserve, collect, and challenge AI-related evidence and how to respond to discovery requests involving opaque or third-party models. The session also covers privilege, spoliation risk, and protective orders in AI-heavy cases. Practical guidance will be provided for litigators handling cases where AI is a tool, a subject, or both.
