At its 2025 Annual Meeting, the American Law Institute (ALI) gave final approval to Restatement of the Law Third, Torts: Miscellaneous Provisions, marking a milestone in the Institute’s comprehensive effort to modernize tort law.
This latest volume fills essential gaps left by prior Restatement projects, addressing a broad range of legal doctrines. Among them are vicarious liability, wrongful death and survival actions, parental standards of care, spoliation of evidence, medical monitoring, statutes of limitations and repose, governmental and other immunities, and interference with voting rights.
The project was led by Reporters Michael D. Green of WashU Law and Nora Freeman Engstrom of Stanford Law School, who worked closely with a team of associate reporters, advisers, and ALI members across more than a decade of drafting and deliberation.
ALI Director Diane P. Wood called the approval a “remarkable achievement,” emphasizing its importance within the broader Torts Third Restatement series. The final publication will follow editorial refinements overseen by the membership. Until then, the approved Tentative Drafts now carry the full authority of ALI and may be cited in legal proceedings.
